最高法院22日裁決支持密西根州禁止州立大學招生採平權措施的公投決定。
聯邦最高法院22日裁定支持密西根州八年前公投通過禁止大學招生採用「平權措施」(affirmative action)的法律。聯邦最高法院這項判例已對支持平權措施的人士形成重大打擊，預期其他州也可能陸續跟進，以禁止大學入學給予種族優惠的考量。
密州是在2006年由選民公投通過提案修正州憲，而禁止該州高等學府實施平權措施，但辛辛那提聯邦第六上訴巡迴法庭在2012年裁定該州這項州憲修正案不合法。密州州府不服上訴，最後要求聯邦最高法院對這項爭議做最後定奪。 Continue reading
WASHINGTON — The Supreme Court on Tuesday upheld a Michigan voter initiative that banned racial preferences in admissions to the state’s public universities.
“This case is not about how the debate about racial preferences should be resolved,” Justice Anthony M. Kennedy wrote in a controlling opinion joined by Chief Justice John G. Roberts Jr., and Justice Samuel A. Alito Jr. “It is about who may resolve it. There is no authority in the Constitution of the United States or in this court’s precedents for the judiciary to set aside Michigan laws that commit this policy determination to the voters.” Continue reading
